# Terms of Service

These Terms of Service ("**Terms**") govern your use of searchyourcollection.com and the Search Your Collection service (together, the "**Service**"), operated by Gonzalo Lope Carrasco, an individual based in Spain ("**we**," "**us**," "**our**"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

## 1. The Service

Search Your Collection lets you upload images into collections and search them by meaning, using image embeddings computed either on your own device or, when necessary, on servers we operate. Features, plans, and limits may change over time as described on our [Pricing](/pricing) page.

## 2. Eligibility and accounts

- You must be at least 16 years old to use the Service.
- You are responsible for keeping your account credentials secure and for all activity under your account.
- You must not share your credentials with anyone, or use them to give other people access to content stored in your account. If you want someone else to have a collection, use the sharing feature described in Section 4a.
- You must provide accurate information when creating your account and keep it up to date.
- One account per person, unless we agree otherwise for business use.

## 3. Subscriptions and billing

- Some features require a paid plan. Current plans and prices are listed on our [Pricing](/pricing) page and may change without notice.
- Paid subscriptions are billed and processed by **Stripe**, acting as merchant of record via Stripe Link. By subscribing, you also agree to Stripe's applicable terms.
- Subscriptions renew automatically for successive billing periods unless cancelled before the renewal date. Because Stripe Link is the merchant of record, you manage or cancel your subscription, update payment details, and access invoices through Stripe Link (link.com), using the billing link in your dashboard.
- The per-collection add-on is billed annually with no monthly option; other plans offer monthly or annual billing as shown on the Pricing page.
- Except where required by law, fees already paid are non-refundable, including for partial billing periods. If you believe you were charged in error, contact us at **contact@searchyourcollection.com** and we will review it in good faith.
- We may change plan pricing going forward; changes will not apply to a billing period you have already paid for.

## 4. Your content

- You retain ownership of the images you upload ("**Your Content**").
- You grant us a limited, non-exclusive license to store, process, and transmit Your Content solely to operate and provide the Service to you (for example, generating thumbnails and computing embeddings).
- You are solely responsible for Your Content and confirm that you have the necessary rights to upload it and that it does not violate any law or third party's rights.
- You can delete Your Content at any time from your dashboard; see our [Privacy Policy](/privacy) for details on retention and deletion.
- **Downgrades and lapsed plans.** If your paid plan ends or is downgraded and your collections exceed the limits of your current plan, those collections become view-only: you can still browse them, download your images, and delete them, but you cannot search them or add to them until you are within your plan's limits again (by resubscribing or by deleting content). If an account remains over its plan's limits for **90 days or more**, we may delete the content that exceeds those limits, after reasonable notice where possible. Content that fits within your current plan is not affected.

## 4a. Sharing collections

- You can create a share link for one of your collections and name the email addresses allowed to use it. Only an account holding one of those addresses, with that address verified, can open the link.
- Anyone who accepts a share link receives **their own independent copy** of the collection. The copy counts against their plan's limits and is not linked to yours: your later changes do not reach it, and deleting your collection does not delete theirs.
- **Sharing is not reversible.** You can turn a link off or let it expire, which stops further copies being made, but you cannot recall copies that already exist. Do not share a collection unless you are content for the recipients to keep it.
- You may only share content you have the right to distribute. Sharing is not permission to redistribute images you do not own the rights to, and Section 4's confirmation of rights applies to every share you create.
- We may remove shared content, disable share links, and remove copies created from them where we are required to by law or where we determine in good faith that the content breaches these Terms.

## 5. Acceptable use

You agree not to use the Service to:

- Upload or store any content that is illegal, or that exploits or endangers minors — we have zero tolerance for child sexual abuse material (CSAM). Any account that uploads such content will be terminated immediately and permanently, with no refund of any fees paid, and we will remove the content and report it to the relevant authorities (including the National Center for Missing & Exploited Children, where applicable).
- Upload, store, or share content that infringes anyone's copyright, trade mark, or other rights.
- Upload malware or attempt to disrupt, overload, or gain unauthorized access to the Service or other users' accounts or data.
- Circumvent plan limits, rate limits, or access controls, or scrape the Service outside of what a normal user would do.
- Use the Service, including its sharing feature, to distribute content to the public or to people who have no right to it.
- Use the Service in a way that violates applicable law.

### Reporting content

If you believe content stored or shared through the Service is illegal or infringes your rights, email **contact@searchyourcollection.com** with enough detail to identify it: the share link or collection concerned, what the content is, why you believe it is unlawful or infringing, and how we can contact you. We review reports promptly, act on those that are sufficiently substantiated, and tell the person who uploaded the content what we removed and why, unless the law prevents us from doing so. Either party can reply to us if they believe we got it wrong.

We terminate the accounts of people who repeatedly infringe others' rights.

We may investigate and take appropriate action, including removing content and suspending or terminating accounts, for violations of this section. In particular, we may **immediately suspend or terminate any account, without notice and without refund**, where we determine in good faith that it is abusing the Service's resources or capabilities — for example, obtaining or attempting to obtain server-side inference or other paid features through automated, scripted, or unauthorized means, generating automated or bulk image manipulation beyond normal use, or otherwise attacking, overloading, or circumventing the security or access controls of the Service.

## 6. Intellectual property

The Service, including its software, design, and branding, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding beyond what's needed to use the Service normally.

## 7. Termination

- You may stop using the Service and request deletion of your account at any time (see our [Privacy Policy](/privacy)).
- We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service, with notice where reasonably possible.
- Sections that by their nature should survive termination (such as Sections 6, 8, 9, and 10) will continue to apply.

## 8. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that search results will be accurate or complete.

## 9. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim arose.

Nothing in these Terms limits liability that cannot be limited under applicable law, and nothing here affects the statutory rights you may have as a consumer under the law of your country of residence.

## 10. Governing law

These Terms are governed by the laws of Spain, without regard to conflict-of-law principles, except where mandatory consumer-protection laws of your country of residence give you additional rights or a different applicable law.

## 11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you. Continued use of the Service after changes take effect means you accept the updated Terms.
